Loss of Use Charge?

I recently rented a car and was in an accident where the rental car was totalled. I thought my own personal auto insurance would cover everything, but the car rental company is charging me a fee for "loss of use", that my personal insurance won't cover. Is the car rental allowed to charge this?


Go back and read through the terms of your rental contract. You should see some information about the loss of use clause.

If you were choosing to use your own personal insurance to cover the rental car, or coverage from a credit card, you should always check the terms, conditions and limitations of these coverages. They will specifically state, if they do or do not cover the loss of use, which is a fee charged by the rental company for compensation for the loss of revenue when the rental car not being able to be rented due to loss or damage. This charge is over and above what the cost of the damage to the rental car is.

I'm sorry, but yes, the car rental company can and will charge loss of use for their vehicles. Their policy on this is stated on your rental contract. When you sign a contract, you are acknowledging that you have read, understood and agree to the terms and conditions on it.
